Can I just say this talk of them being estranged is really weird - my family lives in malibu and they have seen (and I have seen with my own eyes) Shelly and Donald having dinner together. Often they are joined by other people but how estranged are you if you are buddy buddy?

The NBA has more than enough money to keep the franchise afloat and write IOU's to the league on Donald's behalf if necessary. Besides, if he stops paying his bills, he's out instantly anyway. To not sign checks is to essentially sign away the franchise.

Shelly Sterling is nothing but a mosquito to be swatted. The league has no agreement with her and they won't give her the time of day.

Just chill your bones, man.

Unfortunately, I think it's more a case of Silver going all out to try and remove Sterling and forcing him into a corner that he can't get out of, meaning that if he keeps the team, he loses sponsorships, fans and maybe even personnel.

This is what I like about Silver. Stern's first job as commissioner was to try and block Sterling's relocation attempt from San Diego to LA. He failed and has been paranoid about losing ever since to the point where he doesn't want to get involved in anything that may result in the NBA losing in court. OTOH, Silver doesn't care about that. He just wants what's best for the league and if it means going down swinging, then so be it. At least he can say he tried.

But from purely a legal standpoint, I think he knows that Sterling has legal rights and that this can be dragged out for a long time. He knew that going in. He just isn't afraid to confront the challenge.

The thing is, Sterling waived many of his "legal rights" when he signed the paperwork that made him an owner.

He's like a member of a country club who has been (or at least, will be) determined "undesirable"... they have his signature on a contract that states that they can vote him out. His only claim can be financial if he feels that he doesn't get back market-value for the team, much like he'd be able to claim his membership dues back from the country club if they kicked him out.

His lawyers can file motions and request extensions for a few months, but there's no way this case ever sees a courtroom. they can talk about "due process" all they like, but the NBA is a private organization with rules more stringent than the law of the land... rules which Donald agreed to abide by.

If I take off my shirt in a restaurant with a "no shirt, no shoes, no service" sign, I have absolutely no legal recourse against the restaurant when they kick me out because I agreed to those rules, even though it's not illegal for me to be shirtless. If they give me my money back for the meal I ordered, I have even less of a case.
